AramarkOrdered To Pay $105 Million In Alcohol-Related Lawsuit
A jury in Hackensack, N.J., ruled that Philadelphia-based Aramark Corporation, owes $105 million in damages ($30M in compensatory and 75M in Punitive) for serving beer to a drunken football fan whose car crash crippled a toddler.
Jurors ruled that Aramark "willfully and wantonly" disregarded safety in serving Daniel Lanzaro at a New York Giants football game in 1999.
Aramark’s 2004 revenue of $10.2 billion generated $263 million in net income. Juries weighing punitive damages can consider a company’s financial performance.
Defense attorney, David Mazie, told jurors in state Superior Court, "It’s sending a message to Aramark that their policies and procedures on alcohol awareness are not acceptable!"
Aramark attorney David Harris had told the jury that the company was "not perfect" in enforcing alcohol-control policies and may have been negligent. Still, he urged jurors to avoid punitive damages.
Mazie depicted Aramark as a greedy corporation that should be punished. "They don’t care," said Mazie.

The California Department of Alcoholic Beverage Control has issued its new penalty guidelines, which now includes training and corrective action as mitigation in alcohol related violations. R.C.S. recommended these mitigation policies and are pleased that the Department recognized that license holders who train their employees and make efforts to prevent violations should have issues considered when assessing penalties.
